CARS, TRUCKS AND MOTOR VEHICLES
 
Does the Texas Deceptive Trade Practices apply to the purchase or lease of cars, trucks or other motor vehicles?  Absolutely! 
 
If you buy,lease or acquire a motor vehicle, you are a Consumer as that term is defined by the Texas Deceptive Trade Practices Act.  If you are a Consumer under the DTPA, then the next question is whether a Defendant made a false, misleading or deceptive act, statement or practice in the sale or lease of the
car, truck or motor vehicle to you.  If they did, then the last primary question is whether the  misrepresentation or false, misleading or deceptive act or practice was the producing cause of damages to you.  in other words, have you suffered some kind of economic damage, or in laymen's terms, has this affected you monetarily?
 
There are countless ways that a Deceptive Trade Practice could cause you economic damages, but some examples that may help you understand your own problem are as follows:
 
  1. Failure to disclose that a car or truck had a defect or malfunction that the seller knew about. These can be anything from failure to disclose that the car or truck suffered flood damage.
  2. Misrepresenting the true odometer reading on the truck or car.
  3. Concealing previous frame damage to the vehicle.
  4. Representing that the vehicle, truck or car has been repaired when in fact, it was not repaired.
  5. Representing that the vehicle, truck or car has been repaired properly when in fact, the car, truck or vehicle continues to have the same or similar problems.
  6. Representing that the car, truck or motor vehicle has features or characteristics it does not have, like a certain sized engine; power locks or some other feature that was represented to be on the vehicle, but is not.
