 Do I need an attorney to file a claim against Vortens for my toilet failure?  No, you can sue them yourself in small claims court.  But of course, that can be tricky expecially if Vortens brings an attorney.  There is not a lot of risk in going it alone without an attorney because either side has an automatic appeal to the county court in a trial de novo.  A brand new trial. 

You can always hire an attorney and the attorneys fees should be recoverable under a DTPA claim.   You may have difficulty finding a law firm that will represent you on a contingent fee basis.  In a small damage matter like this, the law firm would typically represent you on an hourly basis contingent on the recovery in the case.  You should ask the law firm if they will agree to represent you in this manner.
