1. Is there insurance?
2. Is there insurance coverage?
3. Is the defendant a viable business?

If the answer to ALL of
these is ?NO?, then do not accept the case unless the client pays you in
advance for all work and expenses. If the answer is ?NO? to some of these, make
sure you have a good ?YES? to some of the others and at least get a strong retainer.
