What if my neighbor starts building something in violation of the Deed Restrictions or CCRs? In a typical HOA, there is no HOA policeman who goes around determining if violations are occuring. If violations of the CCRs or Deed Restrictions is happening at your neighbor's house, then it is up to you or some other neighbor to alert the HOA Board about the possible violations.
Is there any liability for me if I alert the HOA Board about a violation?
No, there is no legal liability but of course you may suffer retribution from your neighbor. Once you report a violation, it is up to the Board to confirm it and enforce the rules.
Neighborliness is something else. Calculate the risk of reporting versus the risk of leaving it alone.
