What Happens After a DTPA Inspection?
After a DTPA inspection, the defendant usually sends a response letter. It is not required that a response letter be sent, but that is usually what happens.
The response letter is not required, but can be sent by the defendant. If the defendant sends a response within the 60 day period and it includes an offer of settlement that the claimant wants the case is settled.
If the response is rejected, then the claimant must get more than the offer at trial or they will be limited to the attorneys fees at the time the letter was sent. It is more complicated than that, but that is the net effect of a response letter that is rejected.
