How Much Detail Has to Go Into a DTPA Notice Letter?
You don?t need a lot of detail in a DTPA Notice letter. But you do have to explain what the deceptive
act or practice actually was. For
instance, if you hire Terminix or Orkin to treat your house for termites and it
turns out that the treatment does NOT eliminate the termites, then you could
sue Terminix or Orkin for representing that their services had characteristics
and qualities they did not have, namely that they would eliminate the termite
The second part of a notice sent has to include the specific
dollar amount you seek or the specific thing you want done like a full
treatment or the like.
Under the Texas DTPA, you are entitled to recover your
attorneys? fees in addition to the amount you need to repair your problem. You
can not ask for attorneys? fees if you do not have a lawyer.
