What if I discover construction defects in a house I am building BEFORE it is finished:
Q. Do I point this out to the home builder?
A. Absolutely, you should point it out and demand correction. You can hire a third party inspector or home builder to review construction as it occurs and they can help solve corrections and problems during the construction stage.
Q. Can I choose NOT to buy the house?
A. Yes, but almost all construction contracts will allow the home builder to keep the earnest money. It is common that there are representations about the house that were false and or even fraudulent, and you can assert these misrepresentations and seek the return of the earnest money.
Q. What if know about the construction defects and want to move in and deal with them later? Can I do that?
A. Yes. Your awareness of construction defects does not change the legal obligations of the home builder to deliver what he promised you. Unless your contract says something about this, and I have never seen one that did, you can opt for this solution.
